BOERNE – A 37-yearold city dweller, Gustavo Rodriguez, found himself behind bars Wednesday evening after a 15-year-old girl accused him of sexually assaulting her for years.
Pending a grand jury indictment, Rodriguez could face a first-degree felony charge of continuous sexual abuse of a child, punishable by five to 99 years in state prison.
The arrest warrant affidavit, which led to Rodriguez’s booking, was signed by Precinct 4 Justice of the Peace Freida Pressler Aug. 9 and alleges several details of the possible sexual assault.
“(The victim) explained that the first time Gustavo touched her was when … she was 8 or 9 years old, possibly in fourth grade,” the court document reads. “(The victim) stated she went to Gustavo, who was sitting on the steps to the shed, and asked him what sex was.”
The affidavit, sworn by Kendall County Sheriff’s Office investigator Amanda Meyer, states Rodriguez took the elementary- age girl to a shed on a property where he began the alleged five year stent of sexual assault.
During an interview with the girl, she accused Rodriguez of constantly assaulting her from the time she was 8 or 9 years old until she was about 13.
“(The victim) wrote that from 8 or 9 to 13 years old, Gustavo did a lot of this throughout the years. When asked how many times these incidents occurred, (the victim) stated some months it was four to five times a month. Then, other months he wouldn’t do anything,” the sworn affidavit reads.
The accusations against Rodriguez display an escalating level of sexual assault starting around 2017 before the latest accusation of sexual assault around 2021.
During Meyer’s investigation, a witness claimed Rodriguez admitted to the crimes on several occasions.
“(The witness) stated that in either March or April of 2023, Gustavo changed his story and told her that he knew it was (the victim) and that (she) asked him to do it to her,” the affidavit reads. “(The witness) stated that Gustavo told her that was the only time it happened.”
The same witness said by June, Gustavo was confronted in front of his family members and began to blame the victim for the assault.
“… Gustavo yelled at (the victim), telling (her) to explain to everyone it was her fault,” the court document states.
The witness said this was when the victim began to tell her whole story of the past five years.
While Rodriguez has been charged and booked for the first-degree felony offense of continuous sexual abuse of a child under the age of 17, the charge has yet to go before a grand jury.
Next, a grand jury of Kendall County residents will review evidence of the case and determine whether there is enough to move the case to trial.
Should Rodriguez be indicted, his case will be heard in the 451st state District Court.
