Probation violation sends man to prison for sex assault

A 27-year-old Boerne man accused of violating his probation in a sex-assault case from five years ago is headed to prison, officials said.

Kade Faustino Gomez, 27, has been sentenced by Judge Kirsten Cohoon in a plea agreement in the 451st District Court to seven years behind bars in connection with the May 6, 2020, sexual assault of a 22-year-old Boerne woman.

According to prosecutors, Gomez on June 10, 2022, initially was assessed community supervision to protect the woman from “further victimization and trauma” by confronting her attacker during a public trial.

But on Oct. 22, 2024, according to investigators, the defendant’s community supervision was revoked because he violated his terms of probation by consuming alcohol, possessing sexually explicit material and having a cellular device not connected to a required monitoring app.

The investigation initially began on May 7, 2020, when the Boerne Police Department received a 911 call from the victim, who reported a sexual assault that occurred the previous night at a man’s residence.

The victim was visibly distraught and had visible injuries to both sides of her neck, according to police reports.

That same day, the defendant agreed to come to the Police Department to give a statement, according to officers.

He had cut marks on his neck, but initially denied the assault, claiming the encounter was consensual, investigators said. However, he later confirmed the sexual contact was not consensual, investigators added.

Gomez was charged with sexual assault, according to reports.

The investigation included witness statements, processing the crime scene, a forensic examination and interviewing neighbors.

The defendant’s DNA also was recovered from the victim, investigators said.
